WaveVisual's Terms and Conditions

Welcome to WaveVisual. These Terms and Conditions govern your use of wavevisual.com, the WaveVisual editor, downloads, print orders, subscriptions, credits, QR code features, and related services. If you do not agree to these terms, please do not use WaveVisual.

Who Operates WaveVisual

WaveVisual is operated by Ozan Tunca, registered in Berlin, Germany. You can contact us at [email protected].

Your Account

You are responsible for keeping your account and login information secure. You must provide accurate information when creating an account, making a purchase, requesting support, or placing a print order.

Your Content and Rights

WaveVisual lets you upload or add audio, images, text, URLs, QR destinations, and other content to create designs. You keep ownership of your content. By using WaveVisual, you confirm that you have the rights and permissions needed to use the content you upload or provide, including any music, recordings, images, names, messages, logos, and URLs.

You give WaveVisual a limited, non-exclusive license to host, store, process, reproduce, display, render, export, transmit, and otherwise use your content only as needed to provide, support, secure, and improve the service; fulfill your orders; and comply with legal obligations.

Acceptable Use

You must not use WaveVisual to upload, create, link to, export, or distribute content that:

  • Infringes copyright, trademark, privacy, publicity, or other third-party rights.
  • Is illegal, fraudulent, abusive, hateful, defamatory, obscene, or harmful.
  • Contains malware, phishing, scams, spam, or deceptive links.
  • Attempts to bypass security, payment, rate limits, or access controls.
  • Interferes with WaveVisual, our users, or our infrastructure.

We may remove content, disable links or QR codes, block exports, suspend accounts, refuse service, or take other appropriate action if we believe these terms have been violated or if action is needed for security, legal compliance, fraud prevention, or service reliability.

Spotify Song Metadata

WaveVisual may let you search for songs and use Spotify song metadata, such as track title, artist, album art, links, and audio analysis data, to generate a design. We do not access your Spotify account or private Spotify user data. Spotify content and links remain subject to Spotify's own terms.

QR Codes, Short Links, and Scan Features

WaveVisual may generate QR codes or short links that point to uploaded audio, a WaveVisual design page, Spotify metadata, or a custom URL you provide. You are responsible for making sure QR destinations are accurate, lawful, safe, and appropriate.

We intend QR codes and short links to remain available where reasonably possible, but they are not a permanent hosting guarantee. We may disable, expire, redirect, or remove QR codes, short links, uploaded media, or scan-related features when necessary for security, abuse prevention, legal compliance, technical reliability, discontinued features, service changes, or other operational reasons.

Purchases, Credits, and Subscriptions

WaveVisual may sell single digital orders, credit packs, subscriptions, print products, and other paid features. Prices, included features, export formats, fair-use limits, and availability may change over time. Taxes, exchange rates, payment processor fees, and local charges may apply.

Credits are consumed when used for an eligible export or order. Subscription features are available while your subscription is active and paid, subject to any fair-use limits shown at purchase or in the product. Cancelling a subscription stops future renewals but does not automatically refund past charges unless required by law or approved by WaveVisual.

Digital Exports and Print Orders

Paid digital files may be used for personal or commercial purposes, provided your underlying content and use are lawful and you have the necessary rights. Export generation depends on technical processing and third-party infrastructure, so we do not guarantee that every export will complete instantly or without interruption.

Print products are produced from your design file. Colors, cropping, texture, size, and material appearance may vary slightly from screen previews because screens and print materials reproduce colors differently.

Refunds and Replacements

Refunds and replacements are described in our Refund Policy. In short, damaged print orders may be refunded or replaced, digital orders can be refunded within 30 days of purchase, credit packs can be refunded within 30 days if no credits were used, and further refunds may be issued at WaveVisual's discretion.

WaveVisual Content and Intellectual Property

WaveVisual's website, editor, templates, software, branding, graphics, copy, and other materials are owned by WaveVisual or its licensors. You may not copy, resell, sublicense, reverse engineer, or misuse our service or materials except as allowed by law or by these terms.

Third Party Services

WaveVisual relies on third-party services for payments, hosting, analytics, support, print fulfillment, shipping, song metadata, and other operations. We are not responsible for third-party websites, services, outages, delays, or terms, but we will try to help resolve issues that affect your WaveVisual order or account.

Disclaimer and Limitation of Liability

WaveVisual is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, WaveVisual will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, or loss of business. Nothing in these terms limits liability that cannot legally be limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Changes to These Terms

We may update these terms when our product, business, or legal obligations change. If a change is material, we will take reasonable steps to notify users. Continued use of WaveVisual after changes take effect means you accept the updated terms.

Governing Law

These terms are governed by the laws of Germany, except where consumer protection laws in your country require otherwise.
